Agreement to Terms

By accessing, registering on, or using the Smart Binary platform ("Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use the Platform.

Smart Binary reserves the right to update or modify these Terms at any time. Continued use of the Platform after any change constitutes your acceptance of the updated Terms. The most current version is always available on this page.

Account Registration & Eligibility

To use Smart Binary you must:

• Be at least 18 years of age or the legal trading age in your jurisdiction, whichever is higher
• Provide accurate, complete, and up-to-date information during registration
• Not be a resident of a jurisdiction where binary options trading is prohibited
• Not have a previously suspended or terminated Smart Binary account
• Maintain only one account per person — multiple accounts are prohibited and may result in permanent ban

Smart Binary reserves the right to refuse registration, suspend, or terminate any account at its sole discretion if these requirements are not met.

Account Security

You are solely responsible for maintaining the confidentiality of your account credentials. You must:

• Use a strong, unique password and never share it with anyone
• Enable two-factor authentication (2FA) to protect your account
• Notify Smart Binary immediately if you suspect unauthorized access to your account
• Log out of your account after each session on shared or public devices

Smart Binary will never ask for your password by email, phone, or chat. Any such request should be reported immediately.

Trading Rules

All trading on the Smart Binary platform is subject to the following rules:

• All trades are final once confirmed — trades cannot be reversed, cancelled, or amended after placement
• Minimum trade amount and withdrawal amounts apply as displayed on the platform
• Payout rates are displayed before trade confirmation and are guaranteed at the rate shown
• Smart Binary reserves the right to void trades in cases of technical errors, system malfunctions, or market irregularities
• Any attempt to exploit technical errors, glitches, or unfair advantages will result in account termination and forfeiture of funds
• Demo account funds are virtual and cannot be withdrawn — demo accounts are for practice purposes only

AI Trading System

The Smart Binary AI bot is a tool provided to assist with market analysis and trade automation. By using the AI system, you acknowledge and agree that:

• The AI does not guarantee profits and past signal accuracy does not guarantee future results
• You remain fully responsible for all trades executed by the AI on your account
• Smart Binary is not liable for any losses resulting from AI-executed trades
• You must set appropriate risk parameters including stop-loss and target profit limits before activating automation
• You may disable AI trading at any time through your account settings

Deposits & Withdrawals

• Minimum deposit is $5 USD or equivalent. Minimum withdrawal is $5 USD or equivalent
• Smart Binary charges no deposit or withdrawal fees. However, payment processors may apply their own fees
• Withdrawals are processed to the same payment method used for deposit where possible
• Smart Binary reserves the right to request identity verification (KYC) before processing withdrawals
• Deposits obtained through fraudulent means will be frozen and the account will be terminated
• Smart Binary is not responsible for delays caused by payment processors or banking institutions
• Bonus funds are subject to trading volume requirements before they can be withdrawn

Bonuses & Promotions

Bonuses and promotional offers are subject to their own specific terms and conditions displayed at the time of the offer. General bonus terms include:

• Bonuses are credited to your account balance and are subject to trading volume requirements
• The first deposit 100% bonus requires a minimum trading volume of 10x the bonus amount before withdrawal
• Smart Binary reserves the right to modify, cancel, or expire any bonus at any time
• Only one bonus per user, per promotion period, unless otherwise stated
• Abuse of bonus offers may result in account termination and forfeiture of all funds

Referral Program

• The Smart Binary referral program allows users to earn commission by inviting new traders
• Referral commissions are paid only when the referred user makes a qualifying deposit and trade
• Self-referrals, fake accounts, and fraudulent referrals are strictly prohibited and will result in account termination
• Smart Binary reserves the right to modify referral commission rates at any time
• Referral earnings are subject to the same withdrawal terms as regular account funds

Prohibited Conduct

The following activities are strictly prohibited and will result in immediate account termination and forfeiture of all funds:

• Money laundering, fraud, or any illegal financial activity
• Using automated bots, scripts, or tools not provided by Smart Binary to manipulate the platform
• Creating multiple accounts to abuse bonuses or referral programs
• Attempting to hack, exploit, or disrupt the platform or its infrastructure
• Providing false identity information or impersonating another person
• Using the platform from a jurisdiction where trading is prohibited
• Harassment, abuse, or threatening behavior toward Smart Binary staff or other users

Limitation of Liability

To the maximum extent permitted by applicable law, Smart Binary and its affiliates, directors, employees, and partners shall not be liable for:

• Any trading losses, whether arising from manual trading, AI-assisted trading, or market conditions
• Loss of profits, data, or business opportunities resulting from use of the Platform
• Platform downtime, technical failures, or connectivity issues beyond our reasonable control
• Actions of third-party payment processors or service providers
• Unauthorized access to your account resulting from your failure to maintain account security

Governing Law

These Terms and Conditions are governed by and construed in accordance with international fintech and digital trading compliance frameworks. Smart Binary operates from Sydney, NSW, Australia, and disputes shall be subject to the exclusive jurisdiction of courts in that jurisdiction, unless local consumer protection laws provide otherwise.
